This Alert reviews the Treasury’s recent guidance for the participation of
qualifying financial institutions, that have otherwise elected to be taxed as Subchapter
S Corporations, in the Capital Purchase Program ("CPP"). The deadline
for applications to be submitted is 5:00 pm, EST on February 13, 2009 although
for companies which have previously applied, the submission of a new
application is not required.
