This Alert reviews the Federal Energy Regulatory Commission’s (“FERC”) reaffirmation and clarification of Order No. 712, a final rule governing modifications to its regulations regarding the release of firm interstate pipeline capacity. Rejecting calls from interstate pipelines to lift the maximum rate cap on short-term pipeline services, FERC took the view that it the maintenance of the maximum rate ceilings for short-term pipeline transactions is still necessary to protect against the potential exercise of market power.
